Tornado Cash 제재(Sanction)의 후속조치로 개발자 구속

네덜란드는 토네이도 캐시 개발자를 미국의 Sanction 위반혐의로 체포하였다. 이더리움 믹싱도구인 토네이도 캐시를 사용하는 것도 Sanction에 따르면 불법인 상황인데, 해커들은 대체제로 비트코인 텀블링 서비스 ChipMixer를 사용하고 있다고 알려졌다.

 

토네이도 캐시를 사용하는게 불법이라면, 이는 Code 자체를 불법화한 것인데 악의적인 의도로 작성된 해킹프로그램이 아닌 이상에 이것을 불법화 하는 것은 자유에 대한 과도한 침해이다. 이더리움 개발자 비탈릭 부테린 등을 비롯한 크립토 자유진형에서는 이에 대해 비난의 목소리를 높이고 있으며, 미국에서는 제재의 불법성(공공접근이 가능한 소프트웨어 코드에 대한 Sanction이 가능한 것인가 등)에 대한 소송이 제기되었다.

 

Six users of Tornado Cash, a popular decentralized cryptocurrency service, filed a lawsuit on Thursday against the U.S. Treasury Department, Treasury Secretary Janet Yellen, and other officials over their decision to slap sanctions on the service in August.

The outcome of the case, which turns on the novel legal question of whether the U.S. government can impose sanctions on publicly available software code, is likely to have implications for the crypto industry for years to come.

In a 20-page complaint filed in federal court in Texas, the users claim the decision to sanction Tornado Cash exceeded the government’s authority; violated their free speech and property rights under the U.S. Constitution; and “threatens the ability of law-abiding Americans to engage freely and privately in financial transactions.”
